The U.S. Visa Requirements

A citizen of a foreign country who seeks to enter the U.S. generally must first obtain a U.S. visa, which is placed in the traveler’s passport, a travel document issued by the traveler’s country of citizenship.

Certain international travelers may be eligible to travel to the United States without a visa if they meet the requirements for visa-free travel.

Health Requirements

A pre-departure COVID-19 test is no longer required for travelers entering the U.S. All travelers must provide their contact information within 72 hours of departure, and foreign nationals must sign an attestation that they meet U.S. entry requirements and are vaccinated.

Keep in mind, if you’re a non-U.S. citizen / legal permanent resident, you will not be allowed to board the plane and cannot fly without showing proof of vaccination.

Melvin Warshaw

Former Minister of Immigration, Citizens, and Secretary of State of Canada, the Honorable Gerry Weiner brings a long and distinguished political and business career to APS Global Partners.

Melvin A. Warshaw has more than 40 years of experience as a U. S. estate planning and tax lawyer. He currently represents U. S. and non-U. S. high net worth individuals, families and companies on a wide range of personal and business tax matters, especially in connection with cross-border income and estate tax planning and compliance in the U. S. He is admitted to practice in the Commonwealth of Massachusetts in the U.S.

Mr. Warshaw regularly advises non-U. S. clients on structuring inbound pre-immigration tax strategies including basis step-up in legacy assets, avoiding the U. S. CFC and PFIC anti-deferral tax regimes, optimizing use of foreign tax credits, minimizing green card status as well as advising on and drafting of “drop-off trusts.” He also advises long-term green card holders and U. S. citizens on planning to minimize their U. S. exit tax through gift programs, managing equity compensation and by drafting “expatriation” trusts and considerations of a change of domicile outside the U. S. He has also counseled clients in complying with their U. S. tax filing obligations by engaging accountants and bringing such taxpayers into compliance with their numerous U. S. international tax reporting requirements. He has also advised on the U. S. international tax aspects of cryptocurrency, including how to become U. S. tax compliant and how to mitigate U. S. tax implications prior to and following renouncing U. S. citizenship.

Mr. Warshaw’s legal career has included a variety of different roles in the field of sophisticated international wealth transfer and estate planning. He is a past partner of McDermott Will & Emery’s highly regarded Private Client Department, having established the Boston office practice in 1997. He also served as a senior wealth advisor in JP Morgan Private Bank’s Boston and Greenwich CT offices. He was also formerly general counsel to a large national brokerage that focused on delivering liquidity planning strategies and he has a strong understanding of the array of onshore and offshore life insurance products. Mr. Warshaw began his legal career in the Office of the General Counsel at the Internal Revenue Service National Office in Washington, D.C.

At present, Mr. Warshaw is in sole practice working from his home offices in Wellesley and Stockbridge, Massachusetts. His clients reside throughout the world from India, Singapore, China and Hong Kong to the Caribbean and throughout Europe and in Israel.

Mr. Warshaw is a Fellow of The American College of Trust and Estate Counsel (ACTEC), a national organization of lawyers who are peer-elected to membership. He is also an Academician of The International Academy of Estate and Trust Law. The Academy is an international peer-reviewed organization comprised of a small select group of highly accomplished international private client lawyers in 50 countries.

He is currently a member of the international section of the editorial board of Trusts and Estates magazine and has published numerous articles in the magazine over the last decade. Mr. Warshaw has been a Full Member (TEP) of the Society of Trust and Estate Professionals

(STEP) since 2006. He is a current member of the Boston Probate and Estate Planning Forum, the Boston Estate Planning Council and the International Bar Association (IBA) Private Client Tax Committee. He also has been a longtime member of the American Bar Association Real Property and Probate Section, International Committee of the Income and Transfer Tax Planning Group.

He is a past Chair of the Trusts & Estates Section of the Boston Bar Association. He is currently a Fellow of the Massachusetts Bar Foundation, which administers the IOLTA Grants Program in Massachusetts which awards grants to non-profit organizations that provide civil legal services to low-income clients in the state. Mr. Warshaw is also currently a trustee of his synagogue’s endowment fund and a past Treasurer of the synagogue.

Mr. Warshaw received an L.L.M. (Tax) from Georgetown University Law Center. He received a J.D. from St. Louis University School of Law and he received a B.A. cum laude from the University of Rochester.
